DPP says alleged assault at building site in Cork suburb 'too serious' for district court

The DPP decided that an alleged assault at a building site in Ballincollig in December 2022 was too serious to be dealt with at district court level.

Sergeant John Kelleher said the Director of Public Prosecutions decided that the case against Adrian Murray of 3 Courtown Park, Knocknaheeny, Cork, should be heard by indictment at Cork Circuit Criminal Court. 

There was also DPP consent to a signed plea of guilty being entered at Cork District Court and the accused being sent forward for sentencing at the circuit court.

GREAT ISLAND

The charge against the 32-year-old is brought under Section 3 of the Non-Fatal Offences Against the Person Act and states that on December 6 2022 at Great Island, Ballincollig, Cork, he assaulted another man causing him harm.

Defence solicitor Eddie Burke asked for a precis of the evidence, a copy of the memo of interview with the accused and CCTV of the alleged incident, if available, so that the defence could consider its position.
