Book to evidence to be prepared in case where Cork man accused of aggravated burglary 

On the application of Sergeant John Dineen, Judge Mary Dorgan adjourned the case to allow time for preparation and service of the book of evidence. 

An aggravated burglary charge was brought against a 39-year-old Kanturk man arising out of an alleged offence at a house in Mayfield last August.

Malcolm Kelly of Coolageela, Kanturk, County Cork, appeared at Cork District Court where Detective Garda Martina Drew brought additional charges against him.

Malcolm Kelly had been previously charged with burgling a house at Lagan Grove, Mayfield, Cork, and causing criminal damage to the property on August 11.

At Cork District Court, two additional charges have been brought against him.

He was charged with aggravated burglary at the house in question, the particulars alleging that he produced a hammer in a manner likely to intimidate another person.

Malcolm Kelly was also charged with making a threat to a man at this house that he would kill him or cause him serious harm, contrary to the Non-Fatal Offences Against the Person Act.

On the application of Sergeant John Dineen, Judge Mary Dorgan adjourned the case to allow time for preparation and service of the book of evidence. 

It is not anticipated that this will be done until sometime in early 2026.
