Judge Mary Dorgan adjourned his case until October 22, on the application of Sergeant John Kelleher, to allow time for directions from the DPP.

Two men drove to an apartment on Washington St, Cork, at 5.30am and carried out a burglary where the resident was assaulted and had property stolen, including a 40” TV, it was claimed in court.

These allegations were made at Cork District Court where Garda Patrick Houlihan and Detective Garda Myles Moran objected to bail being granted to the two accused, 31-year-old Timmy Saubolle of Lagan Grove, Mayfield, Cork, and 43-year-old Michael Ryan of 94 Curraheen Drive, Bishopstown, Cork.

They were charged that on September 26 they carried out a burglary in Washington St, Cork.

The alleged circumstances were that they arrived in the area at around 5.30am in an Opel Astra.

It was alleged by gardaí that the injured party was subjected to an assault in his apartment and that the two defendants took a number of items including a 40” TV, a PlayStation 4, a mobile phone, and €150 in cash.

It was further alleged that they were seen on high-quality CCTV footage loading the stolen items into the Astra.

In a second charge against both defendants, it is alleged that they carried out a theft at Spar, Patrick Street, Cork, on the same date.

Gardaí spoke with staff who said two men and a woman entered the store, selected groceries to the value of €16, and left without making a payment.

Judge Mary Dorgan refused the application for bail made by Mr Saubolle through barrister Paula McCarthy.

She remanded him in custody until October 9, when he is to appear by video link from prison at Cork District Court.

Mr Ryan was granted bail in his application through solicitor Aoife Buttimer on his own bond of €1,000 with no lodgement, on condition that he resides at 94 Curraheen Drive, Bishopstown, Cork; does not bring any drugs or related paraphernalia to the house; is contactable at all times by gardaí; signs on three times a week at Togher Garda Station; has no contact with the injured party or the co-accused, and keeps a nightly curfew between 11pm and 7am.

Judge Dorgan adjourned his case until October 22, on the application of Sergeant John Kelleher, to allow time for directions from the DPP.
