A 50-year-old man verbally abused gardaí and warned them that they could not arrest him during a volatile situation last year.
Defence solicitor Frank Buttimer accepted that the conduct of Eoin Wyer of Ashcroft, Abbeyside, Dungarvan, Co Waterford, was egregious and unacceptable but that he had been sober since this incident of being drunk and threatening on February 11, 2024.
Sergeant John Dineen said that the public order incident occurred when he ran from gardaí by the Supervalu store in Carrigaline, Co Cork.
Sgt Dineen said, “As he was about to be arrested he said, “F*** you, you c***. You can’t arrest me, get your hands off me, you prick.”
At Cork District Court Eoin Wyer has pleaded guilty to being drunk and a danger on February 11, 2024, at Owenabue car park in Carrigaline.
And in respect of similar offences the following day at Cornmarket Street, Cork, he also pleaded guilty.
Sgt Dineen said the defendant had previous convictions for nine thefts and 10 counts of being drunk and a danger.
Mr Buttimer said that Mr Wyer had spent the last number of months in residential alcohol treatment where he would remain until October.
Judge Mary Dorgan welcomed the fact the accused was in rehabilitation.
Speaking directly to the accused the judge said: “It is very commendable to put your addiction behind you.”
The judge imposed an overall sentence of two months which was suspended.
