The court heard after the BMW had parked, it began rocking from side to side in the car park at the Bantry Airstrip, above.

A man who admitted having sex in a public place in the middle of the afternoon claimed he did not realise what he was doing was against the law, the district court has heard.

Sergeant Tom Mulcahy told Bantry District Court that a woman and her daughter had driven to Bantry airstrip — a popular dog walking area — on the afternoon of June 10, 2025. They parked in the small parking area and the woman brought her dog for a walk along the pathway by the shore of Bantry Bay.

The woman’s daughter had stayed in the car in the car park when another vehicle, a black BMW  parked alongside at about 2pm. The court heard after the BMW had parked, it began rocking from side to side and the occupants could be heard engaging in sexual activity inside the car.

When the woman returned with her dog, she saw what was happening and approached the BMW to complain to the occupants. The court was told the man — identified as Pavlo Holovinov  aged 35, with an address at Riverside, Glengarriff, Co Cork — acknowledged the woman but then continued engaging in sexual intercourse with his female partner.

The woman took a photo of the vehicle and contacted gardaí, but by the time they arrived the BMW had left the area. Holovinov was identified as the owner and admitted he was in the car at the time.

Defence solicitor Flor Murphy said Holovinov, who is originally from Ukraine, did not realise what he was doing was illegal and apologised to the court. He said Holovinov was a full-time carer for his mother and was pleading guilty to engaging in sexual intercourse in a public place contrary to Section 45 of the Criminal Law Sexual Offences Act 2017.

Judge Joanne Carroll convicted Holovinov and fined him €250, allowing him three months to pay the fine.
