A 43-year-old man accused of assaulting a woman causing her harm at a pub in Cork city was allegedly swinging a stool in another direction when it flew from his hands striking the injured party in the head.

This was the allegation outlined at Cork District Court in the case against John Daly of 22 Manor Rd, Manor Farm, Lehenaghbeg, Cork.

He faces a charge which states that on December 3, 2022, at Clancy’s Bar, Princes St, Cork, he assaulted a woman causing her harm, contrary to the Non-Fatal Offences Against the Person Act.

After Judge Mary Dorgan heard the outline of the prosecution evidence, she said that she would need to see CCTV footage of the incident and see a medical report on the injured party before deciding on jurisdiction.

If the judge finds that the allegations are too serious for the district court, it will be sent forward to the jurisdiction of the Cork Circuit Criminal Court.

Sergeant Aisling Murphy said: “It is alleged that on December 3, 2022, at Clancy’s Bar, Princes St, Cork, John Daly was having an altercation with another man in the bar and that he picked up a bar stool, swinging it.

“The stool is alleged to have left the hands of John Daly and that it struck [a woman] who suffered concussion and a laceration to the side of the head as a result of the incident which required a number of stitches.”
