Man produced knife and threatened brother during dispute, Cork court told

The case was then adjourned until November 26 for directions from the Director of Public Prosecutions.
A 43-year-old man with no convictions of any kind was arrested following allegations that he produced a knife during an assault on his brother and threatened to “finish it with him”.
Garda Liam English objected to bail being granted to Oleh Shevel and said that the defendant’s brother, Roman Shevel, alleged that during a dispute at their home at 22 Bellview Crescent, Old Youghal Rd, on Tuesday September 16 Oleh Shevel made a threat that made his brother believe he was going to be killed or seriously injured.
It is alleged that during a dispute he produced a small sharp kitchen knife in the course of an assault on his brother and made the threat, Garda English said as he objected to bail based on the seriousness of the allegations.
Shane Collins-Daly defence solicitor said the defendant made certain admissions but gave a differing account.
He admitted there was a dispute, he denied making any threat and he said that a third male in the house would back up his version of events.
Allegation
Regarding the prosecution allegation of a threat being made, the defendant is not charged with that. He is charged with assault causing harm to his brother and producing a knife on September 16.
Mr Collins-Daly submitted that it was a suitable case for bail, stressing that the 43-year-old is working full-time in Cork and has no previous convictions. He said he would move out of the house at Bellview Crescent if granted bail.
“He would make a promise to stay away from his brother, stay away from the address, sign at a garda station every day and produce an address where he would stay,” Mr Collins Daly said.
Garda English said: “We believe he would go back to the house.”
Dispute
Judge Mary Dorgan noted from the evidence that the defendant’s brother was uninjured although it was allegedly a serious dispute and she said she was granting bail.
Conditions require him to have no contact with his brother, provide an alternative address within 48 hours, sign daily at Anglesea Street garda station, stay away from Old Youghal Road, and in particular not to go near 22 Bellview Crescent, even if invited, abstain from intoxicants, not carry knives or implements and surrender his passport.
The case was then adjourned until November 26 for directions from the Director of Public Prosecutions.
Proceedings were translated by a Ukrainian interpreter, and one was directed for the next court appearance.
