A 37-year-old man who was exasperated by the noise and house parties from students around UCC reached in a window, picked up a jumper and threw it at a tenant saying, “Keep it down now lads”, and today he faced sentencing for trespass.

Roy Sexton of 5 Bandon Road had the case against him listed for trial at Cork Circuit Criminal Court but he pleaded guilty to the trespass charge instead.

Detective Garda Martina Felle testified that at 11.35pm on January 23 2022 at Bandon Road the defendant went to a property where students were living and he reached in the window of a downstairs bedroom after first banging loudly at the door.

“Roy Sexton reached in through the window and said, ‘Keep it down now lads, I’m telling you’. He reached on to the bedside locker where there was a cap and a jumper.

"He threw the cap and jumper at the student,” Det Garda Felle said.

The student did not know Mr Sexton but described a very distinctive tattoo on his right hand.

When approached by gardaí, Roy Sexton said that he had complained to gardaí in the past about students making a lot of noise in the area, having house parties and on one occasion a student running through the area knocking over his partner.

Paula McCarthy, defence barrister, said that while the accused had previous convictions none was serious enough for the circuit court.

“There were issues with house parties. On this occasion he put his hand in the window – that was the extent of the trespass.

"He threw the jumper and he left. And he has not come to adverse garda attention since 2022,” Ms McCarthy said.

Judge Helen Boyle said that on payment of €500 compensation to the student, Roy Sexton could have the case finalised by way of a community service order.

It was put back until November for the compensation to be raised and for an issue to do with community service to be resolved.
