Last year the Court of Appeal rejected Mr Delaney's appeal against an earlier High Court's ruling that the Corporate Watchdog, formerly known as the ODCE, was entitled to use just over 1100 documents relating to him.

Mr Delaney had argued before the High Court that the corporate watchdog, formerly known as the ODCE, was not entitled to use just over 1100 documents relating to him that were seized from the FAI on the grounds that they were covered by legal professional privilege (LPP)

Ms Justice Leonie Reynolds granted most of the costs of the prolonged hearings over privilege to the Office of the Director of Corporate Enforcement (ODCE).
