Cork lorry driver pleads guilty to careless driving causing death of pensioner

A lorry driver entered a guilty plea to a charge of careless driving causing the death of a woman in Charleville almost three years ago.

Damien Mulvey (43) of Avondale, Knockbarry, Buttevant, County Cork, was arraigned at Cork Circuit Criminal Court on the single charge of careless driving causing death.

He pleaded guilty to the charge which stated that his driving at Main Street, Rathgoggin Middle, Charleville, County Cork, on the afternoon of May 15, 2023, was careless in that he drove without due care and attention causing the death of pensioner Margaret Lyons.

The family of the deceased were present in court when Mr Mulvey pleaded guilty to this charge.

His senior counsel Jane Hyland said as soon as the guilty plea was entered: “On behalf of Mr Mulvey, he would like to express remorse on the death of this lady and offer his condolences to the family.” 

Ms Hyland asked for an adjournment of sentencing so that testimonials on behalf of the accused could be prepared. 

The defence senior counsel also asked for free legal to be extended for the preparation of a doctor’s report.

Sentencing was adjourned until May 11, at which time the family of the deceased will have an opportunity to present a victim impact statement.

Judge Helen Boyle also addressed the family of the deceased in court saying that she would like to express sincere condolences to them.
