Cork man drove stolen vehicle directly at a garda

A MAN who drove a stolen car directly at a garda got another year in jail today as it emerged that the accused told his probation officer he wasn’t interested in cooperating.

Kelvin McNamara pleaded with the sentencing judge for another chance to engage with the probation service today, saying he had changed his mind and now wanted to work with the probation service.

Judge Seán Ó Donnabháin said to McNamara’s barrister Peter O’Flynn today at Cork Circuit Criminal Court that McNamara’s change of heart was too little too late.

The judge said to the young man, “I know you have changed your mind. I have read the probation report. You were given prolonged attendances.

"You missed five appointments. You told them you had no interest. Unfortunately, you did not avail of the opportunity given to you.”

Mr O’Flynn BL asked if he would consider not lifting the suspension on all of the 12 months. The judge refused. That left McNamara commencing one year in jail today.

The background to the crime was that a motorcycle guard in high visibility gear with lights and siren indicated for the driver of a stolen car to stop but he looked at the officer and then drove at him.

Detective Garda Brian Maher said Garda Bernard Sheehan would have been struck by the car drive by Kelvin McNamara but for the fact that the motorcycle garda managed to take evasive action.

Judge Ó Donnabháin originally imposed a three-year jail term with the last year suspended at Cork Circuit Criminal Court.

The suspension was lifted on that last year.

The judge said it was a very serious case of dangerous driving and endangerment.

The endangerment charge against Kelvin McNamara, aged 19, of 79 Ardmore Avenue, Knocknaheeny, Cork, stated that he created a substantial risk of causing the death of or serious injury to Garda Bernard Sheehan.

The incident at the centre of this case occurred on July 10, 2017, at Eglantine Street.

McNamara was also sentenced on a variety of dangerous driving charges at areas including Wolfe Tone Street, Eamon DeValera bridge and Michael Collins bridge in Cork city on the same date.
